These terms govern the use of the EvePics platform by organizers (the “User”).
§ 1 Scope
These terms apply to the use of the EvePics platform provided by [NAME / COMPANY] (the “Provider”) for collecting, reviewing and publishing photos and videos for events.
§ 2 Service description
The Provider offers a web application through which event guests upload media, the User reviews it and then releases it as an album. The specific scope of features results from the current version of the application.
§ 3 Account and registration
Organizer accounts are created by the Provider or an administrator. Credentials must be kept secret and protected from third-party access.
§ 4 User obligations
The User undertakes to process and release only lawful content. The User ensures that the required consent of depicted persons is in place and that no third-party rights (in particular copyright, personality or trademark rights) are infringed.
Unlawful, offensive or otherwise illegal content is prohibited.
§ 5 Responsibility for content
The User (organizer) is solely responsible for the content uploaded to and released through their event. In data protection terms, the User is generally the controller for the processing of their guests' media.
§ 6 Availability
The Provider strives for high availability but does not owe uninterrupted availability. Maintenance, force majeure or technical faults may lead to temporary restrictions.
§ 7 Liability
The Provider is liable without limitation for intent and gross negligence and under the Product Liability Act. For simple negligence the Provider is liable only for breach of an essential contractual obligation, limited to foreseeable, typical damage. Otherwise liability is excluded.
§ 8 Term and termination
Either party may end the usage relationship at any time unless otherwise agreed. When an event or account is deleted, the associated data is removed in accordance with the Privacy Policy.
§ 9 Changes to these terms
The Provider may amend these terms with effect for the future. Material changes will be communicated in an appropriate manner.
§ 10 Final provisions
The law of the Federal Republic of Germany applies. Where permissible, the place of jurisdiction is [JURISDICTION / CITY]. Should any provision be invalid, the validity of the remaining provisions remains unaffected.
